Welcome to the Terms of Use of OpenClassrooms' website!

This document aims to detail how our Platform operates, particularly regarding the following points:

  • The creation/deletion of an Account,
  • Intellectual property,
  • The use of artificial intelligence tools.

This will help you understand the relationship between "you," the user of the Platform, and "us," OpenClassrooms, a simplified joint-stock company, along with our two subsidiaries, OpenClassrooms Inc. and OpenClassrooms Limited. We provide this Platform so that you can access our Courses and Programs.

Before browsing, you acknowledge that you have read and accepted, via the checkbox, the entirety of the Terms of Use and our Privacy Policy.

Furthermore, we may modify our Terms of Use at any time to adapt to changes on the Platform (introduction of new features, removal or modification of existing features, etc.). If you continue to browse after these changes, it means that you unreservedly accept the updates. The applicable Terms of Use will be those in effect at the time of your use of the Platform. Feel free to check this document regularly to stay informed of these modifications.

Please note that if you do not agree with the entire content of the Terms of Use, either at the time of your registration or when updates occur, you will not be able to use our Platform and services.

We make every effort to ensure the accuracy of the information published on our Platform. However, some elements may be incorrect or outdated. Do not hesitate to contact our teams if you have any doubts or questions.

How our Platform works

How to access the Platform?

If You are a Visitor

Using our Platform is free and requires no purchase.

You can browse our Platform even if you have not created an Account. In this case, you are considered a visitor.

As a visitor, you can access the Platform, but you will not be able to take advantage of all its features. For example, certain access, such as our Courses, will not be available to you.

If You are a Member

If you want to access our Courses and/or Programs, as well as certain features, you must create an Account, as described below.

Once your Account is created, you will be able to access your profile page and enter your information. Please be careful, as some information is mandatory while others are optional.

Platform Interruptions and Malfunctions

We are committed to doing everything possible to ensure the proper functioning of the Platform.

However, access may be interrupted due to:

  • Maintenance and emergencies.
  • Updates (technical improvements, feature upgrades, etc.).

These interruptions are necessary to ensure the longevity and performance of our Platform.

Despite our efforts, the Platform may experience malfunctions. In such cases, we will do our best to resolve the issue as soon as possible. However, we cannot be held responsible for these interruptions, regardless of their cause, duration, or frequency. You will not be entitled to any compensation or reimbursement.

Additionally, if you misuse the Platform, you acknowledge that certain data or materials (e.g., files, configurations) may be lost, altered, or exposed.

This breach may concern compliance with our Terms of Use, the Code of Conduct, or any other document that applies to you.

If you do not put an end to the breach as soon as possible or if you cannot correct it, please note that we may temporarily or permanently suspend your account, depending on the severity.

Intellectual Property

What are our intellectual property rights?

We hold all rights, including intellectual property rights, or we have obtained the necessary authorizations from third parties on the technical, graphic, textual, or other elements, whether visible or not, on our Platform, as well as on the elements associated with the services we provide you. For example, this may include texts, graphics, software, multimedia files, photographs, images, videos, sounds, plans, graphic charters, technologies, source codes, names, trademarks, logos, visuals, databases, etc. (hereinafter referred to as "Elements").

Therefore, if you have not obtained our prior written consent, you may not:

  • Make the Elements available, whether free of charge or for a fee, to third parties, either partially or fully, without the prior written consent of OpenClassrooms or the legitimate rights holder.

Finally, note that your civil and/or criminal liability may be engaged if you use the Elements without our consent.

What rules apply to our Courses and Programs?

Regarding our Courses, they are protected by one or more intellectual property rights, which we hold or co-hold when created with one of our partners.

As our mission is to make education accessible, we have chosen to license our Courses under Creative Commons. This means that we remain the owner but grant you broad permission to use them.

Unless otherwise stated, they are generally published under the CC-BY-SA license. This means that you can share and modify the content, provided that you credit us and share your changes under the same license that we have chosen.

Before using them, you must read the full content of the license associated with our Courses to verify whether your intended use is permitted under that license.

For more information on Creative Commons licenses, you can visit the website of the international organization “creativecommons.org.”

Regarding our Programs, they remain our exclusive property, and you may not use them without our written permission.

What are your intellectual property rights over your content?

You retain the rights to the content you produce as part of your training. This may include, in particular, your projects.

However, in exchange for using our Platform, you grant us a worldwide, non-exclusive, transferable, and sub-licensable license, allowing us to copy, store, correct, adapt, and distribute all your content, including projects and any other activity you perform on the Platform or as part of your training.

This license is granted as you publish this content and ends if the content is deleted.

By uploading content, you guarantee that you hold all rights to that content (intellectual property, personality rights, privacy rights) and, more generally, that your content does not infringe upon the rights of third parties or violate any applicable laws. In case of a dispute, you may be held liable on this basis.

What happens if you click on a hyperlink?

Our Platform may direct you to external sites via hyperlinks.

By clicking on them, you understand that you are no longer on our Platform and accept that we are not responsible for the information published on these external sites, their accuracy, or their privacy and security practices. You browse at your own risk. We also cannot be held responsible for any damage or loss caused or alleged to be caused in connection with the use of these external sites.

Discussion Spaces

You can access Discussion Spaces where you can view messages posted or exchanged with other Members.

Be aware that all messages you post will be visible to all Members. Therefore, we recommend using private messaging systems if your exchange concerns only one person.

Furthermore, when you post a message, you agree to abide by the rules of the Code of Conduct described below.

What does our Code of conduct include?

Our Platform has one or more Discussion Spaces, such as the forum, based on mutual help and sharing among Members.

Everyone is invited to participate by creating an account or using external platforms like the one dedicated to the OpenClassrooms community.

Wherever you post your messages, you must comply with legal rules and basic courtesy principles.

Thus, you agree to:

  1. Respect other members: Treat others as you would like to be treated. Do not use offensive, obscene, defamatory, abusive, harassing, racist, sexist, homophobic, hateful, or discriminatory language or incite terrorist acts.
  1. Communicate clearly: Ensure that your messages are understandable and free of misinformation. Use appropriate language, avoid messages written entirely in capital letters, and refrain from using overly technical jargon unless necessary. Avoid abbreviations and check your spelling.
  1. Maintain a friendly environment: Foster a positive atmosphere; appreciate others’ contributions and provide constructive feedback in case of disagreement. Messages that are duplicated, off-topic, or intended to incite controversy should not be posted.
  1. Be honest and act with integrity: Do not attempt to deceive others by impersonating someone else or misrepresenting your identity.
  1. Protect your privacy: Never share personal information about yourself or others without their written consent.
  1. Avoid spam and advertisements: Do not use our Discussion Spaces for advertising, spam, or self-promotion.
  1. Respect intellectual property rights: Only publish content that you own or for which you have the express permission of the author, and correctly cite your sources.
  1. Contribute constructively: Help maintain the quality of content by reporting any abuse and avoiding participation in discussions that violate this Code.

We rely on you to follow these principles to maintain a safe, welcoming, collaborative, and respectful community.

What are the objectives of moderation?

You can post messages, content, or information directly without prior control on our part.

However, they may be moderated after publication if they are reported.

Our role is to ensure the proper functioning of the Discussion Spaces, which means that violations of the Code of Conduct or applicable laws may result in sanctions, ranging from a warning to permanent exclusion from the community or even from the Platform.

How can you report content?

You can report any message or content posted in the Discussion Spaces that violates the Terms of Use or legal provisions.

To do so, you have several options:

  • Use the option to report content directly via our platform dedicated to the OpenClassrooms community.
  • Submit a report via our form.
  • Use the form available on the Platform by clicking on the "Contact Us" tab.

Your report must include the following information for your request to be processed:

  • Your identity (name, first name, email).
  • The exact URL of the offending content, along with a sufficiently justified explanation of why it is illegal.
  • A copy of the message you previously sent to the author requesting modification or removal of the content, or an explanation of why you were unable to contact the author.

Following a report, we may remove any content that is clearly illegal or does not comply with the Terms of Use.

The Use of artificial intelligence tools

We place innovation at the heart of our educational approach and our commitment to providing a superior user experience. In this spirit, we use artificial intelligence tools (“AI Tools”) to enhance the services we offer you.

These AI Tools allow us to personalize your learning journey, optimize the relevance of the training programs we recommend, and refine interactions on our Platform to make them more intuitive according to your needs. We also use these AI Tools in the creation and updating of videos integrated into our Courses and Programs.

AI Tools Available to You

Beyond the AI Tools mentioned above, we also provide you with AI Tools to enrich your interactions with Members or personalize your training.

As part of this, we grant you a global, revocable, non-exclusive, non-sublicensable, and non-transferable right to use them, particularly for generating content, during the duration of your paid training, in compliance with these Terms of Use, the general service conditions or contract you signed with us, OpenClassrooms’ code of ethics, and applicable laws.

You are free at any time to choose not to use these AI Tools.

Therefore, if you decide to use them, you are responsible for the data you input, ensuring that it does not violate any applicable laws or the agreements binding you to us. You declare and guarantee that you hold all necessary rights, licenses, and permissions to integrate data into these AI Tools.

Finally, you must not include personal or sensitive data in your messages or content unless you have obtained the consent of the concerned individuals. Otherwise, at a minimum, you must pseudonymize your searches.

Ownership of Generated Content

You remain the owner of the data you enter during your search. Additionally, you are also the owner of the data and content you generate using our AI Tools.

We transfer to you all intellectual property rights, if they are eligible for protection. However, this transfer of rights does not extend to content produced by other Members or third parties.

We also draw your attention to the fact that results may not be unique, and other Members may receive similar outputs due to the nature of artificial intelligence.

Data Storage

When you enter data into our AI Tools, we may store the history of your messages in order to display it as history if the AI Tool allows it and we have authorized it.

In these conditions, you authorize us to use your data and outputs to improve our models and services. For more details about data privacy and security, you can refer to Microsoft's Azure documentation available on their website.

However, if your content is hosted on third-party servers, it is in no way shared with third parties or used to train their tools.

Prohibited Uses

You must not use our AI Tools for illegal, harmful, unethical, or prohibited purposes under applicable law, including but not limited to the following:

  • Surveillance of OpenClassrooms employees, Members, or any third party, whether in private or public spaces;
  • Discriminatory or exploitative purposes that could result in harm or unfair treatment of students or third parties;
  • Violating individuals' privacy rights or data protection rights;
  • Violating the intellectual property rights of OpenClassrooms or a third party;
  • Any attempt to misuse, circumvent, or exploit our AI Tools in a manner not authorized by the Terms of Use or any other document of OpenClassrooms and/or that is not consistent with the intended objectives.

How are your personal data protected?

We pay special attention to the protection of your personal data.

This is why we have written our Personal Data Protection Policy, which provides a detailed description of how we use your personal data, the reasons for doing so, and our use of cookies. Feel free to read this document for more information.

In what cases can our responsibility be engaged?

We are responsible for all content under our editorial control. For example, this includes our Courses, Programs, or information related to them.

In such cases, if our responsibility is proven, we will only be responsible for direct damages to the concerned individuals.

Indirect damages resulting from the use of the Platform, such as loss of business (revenue, income, or profit...), lost opportunities, damage to image or reputation, commercial or economic harm, are not covered.

Exceptions

Your content

All content created and published by you or a third party is your or their responsibility.

In this case, we act as a host for the information and content uploaded by you or these third parties on the Platform. This means we are subject to a limited liability regime, and we must remove illegal content only upon notification, as described in the reporting procedure above.

An external Cause to OpenClassrooms

We will not be held liable for damages resulting from your actions, issues inherent to the operation of the Internet and telecommunications networks in general, regardless of their nature, actions by third parties, or cases of force majeure.

Data Loss

Any data loss you might experience, even if caused by OpenClassrooms, will not be compensated.

Force Majeure

Neither you nor we will be held responsible if an event occurs outside of your or our control, which could not have been reasonably anticipated when accepting the Terms of Use, and whose effects cannot be avoided by appropriate measures.

In case of force majeure, neither you nor we will be obligated to fulfill our commitments as long as the event persists.

However, the concerned party will strive to minimize the consequences as much as possible. If the force majeure event is final, neither party will be obligated to fulfill their commitments, and we will determine together the consequences on our relationship.

Disputes

The Terms of Use are governed by French law.

In case of difficulty regarding the validity, application, or interpretation of the Terms of Use, both you and we agree to seek an amicable solution within three (3) months before involving the courts.

Only the courts under the jurisdiction of the Paris Court of Appeal will be competent to handle the dispute, regardless of the place of execution or the domicile of the defendant. This jurisdiction clause also applies in cases of summary proceedings, multiple defendants, or third-party claims.

The Recruiter must provide a valid email address, which OpenClassrooms will use to confirm registration to the Talent Marketplace. The Recruiter will then receive a login and password, which can be changed online. These credentials are personal and confidential. Such deletion does not constitute a waiver of legal or extralegal proceedings OpenClassrooms may initiate against the non-compliant Recruiter.

4. Recruiter Obligations

Each Recruiter agrees to:

  • Provide accurate, complete, and up-to-date information;
  • Not create a false identity or impersonate another person or create an account for someone else;

If OpenClassrooms suspects a violation that could harm its brand or reputation, it may delete the Recruiter’s Account without notice, in addition to pursuing legal or extralegal remedies.

5. OpenClassrooms’ Obligations

Each party shall take all necessary measures to ensure compliance with these regulations while executing these Special Terms, in line with the privacy policy available on the Platform.

Registration and execution of obligations under these Special Terms do not imply any Data Processing by one party on behalf of the other as a Processor under the GDPR.

If, for any reason, either party must process personal data on behalf of the other, it is expressly agreed that the processing party will act as a Processor under the GDPR.

In such cases, the parties agree to sign a binding agreement defining, among other things: (i) the purpose and duration of the Processing, (ii) the nature and purpose of the Processing, (iii) the type of Personal Data, (iv) categories of Data Subjects, (v) obligations and rights of the Controller and Processor, (vi) communication methods, and (vii) applicable security measures, in compliance with Article 28-3 of the GDPR.
